Standard Terms for System Integration & IT Consulting

Effective Date: February 16, 2026

01. Acceptance of Agreement

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client”, “you”) and PT Nakiba Data Teknologi (“Nakiba”, “we”, “us”, or “our”), concerning your access to and use of our system integration services, IT consultancy, and website.

By accessing our services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

02. Scope of IT Services

System Integration

Provision of ETL pipelines, Big Data architecture, and complex system interoperability solutions.

Managed Services

Ongoing maintenance, monitoring, and technical support for deployed infrastructures.

03. Intellectual Property Rights

Unless otherwise indicated in a specific Statement of Work (SOW), all source code, databases, functionality, software, website designs, and trademarks (the “Content”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

"Nakiba grants the Client a non-exclusive, non-transferable license to use the integrated systems provided solely for internal business operations, subject to full payment of service fees."

04. Limitation of Liability

To the maximum extent permitted by law, Nakiba shall not be liable for:

Any loss of data or corruption of databases resulting from third-party cloud provider failures.
Business interruptions or loss of profits arising from cyber-attacks beyond our reasonable control.
Indirect, incidental, or consequential damages of any kind.

05. Third-Party Providers

Our services often integrate with third-party platforms (e.g., AWS, Azure, Google Cloud, Informatica). Your use of these platforms is subject to their respective terms. Nakiba is not responsible for any changes, outages, or terminations of service by these third-party providers.

06. Governing Law & Jurisdiction

These Terms and your use of our services are governed by and construed in accordance with the laws of the Republic of Indonesia. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in South Tangerang, Banten.
